May 18, 2012 - It's time to celebrate! Governor Hickenlooper has officially signed HB 12-1286, the new Colorado film incentive bill. The law will take effect on July 1, 2012. A big thank you to everyone who spent countless hours helping to get this new film incentive law passed!May 9, 2012 - HB 12-1286 has officially passed the second & third reading on the Senate floor! The new incentive bill passes the Senate floor with a new amendment that excludes "obscene" films from qualifying for the incentive. The amendment was quickly accepted at the second & third reading on the Senate floor, voting in favor of HB 12-1286 with a final vote of 24-11. Good things are finally happening for the Colorado film industry! The Governor still needs to sign the bill, but we all know he has been supporting this all along.
May 4, 2012 - HB 12-1286 passes Appropriations Committee today by a very narrow margin, voted in favor 5-4. The newly proposed Colorado film incentive bill now officially heads to the Senate Floor! We are coming down to the last 2 votes before it gets signed by the Governor. Thanks to everyone who wrote letters to their Representatives. Clearly that one vote could have changed everything today.
May 1, 2012 - The Finance Committee voted 5-1 in favor of HB 12-1286! On Friday May 4th, the bill will go to the Appropriations Committee. If all goes well there, it will finally head to the Senate floor - Final Phase 2 and 3!
April 30, 2012 - Last Monday the Business, Labor and Technology Committee has pushed forward with HB 12-1286 with a vote of 5-2.
April 16, 2012 - On Thursday April 12th, the House has officially approved and adopted HB 12-1286 with a vote of 45-20. Shortly after that, on Monday April 16th, the Senate has quickly accepted the bill and has now assigned it to the Business, Labor and Technology and Appropriations Committees.
Right now, we have great traction and support in these committees. The Business, Labor and Technology and Appropriations Committees will only hear from a handful of Colorado's film, television and new media leaders. There is just a small amount of time left in this legislative session, scheduled to end on May 9th, and we want to make this as easy on the Senators as possible.
Assuming the bill is successful in the BLT committee, HB 12-1286 will be sent directly to Appropriations and then to the second and third reading on Senate floor. If it passes all of those steps without any amendments, it goes to the Governor to be signed into law. The Senate could propose some amendments, if it does, the bill will have to go to the House for ratification and then to the Governor. Needless to say, we are in the home stretch.
This is really amazing news since every other proposed incentive bill in the past has been declined by this point. We can't celebrate just yet, but we are getting closer than ever to attaining a reasonable and much more competitive film incentive program for Colorado. You can still help us move forward by writing a letter to your Representative, or you can make a donation to the Colorado Cinema Fund.
As the bill now heads to the Senate, it is especially important now that we raise enough money to support Colorado's film incentive program. The work performed on behalf of the Colorado film incentive has been remarkable and inspired and we, as a community, need to honor the work done on our behalf. The proposed incentive bill would not be this far along in the process without the tireless work of those people involved.
House Bill 12-1286 will boost the current Colorado film incentives from 10% to 20%, as well as provide a state guarantee for a senior bank loan for production companies (the first of it's kind in the country). The proposed new bill will dedicate $3 million (currently about $400,000) to use for the incentive tax breaks. It will now also require 50% of the workforce to be from Colorado (up from 25%). In-state production companies will still have to spend at least $100,000 to qualify, and out-of-state companies will have to spend at least $1,000,000 (currently only $250,000) to receive the incentive rebates. Want to know the process of how a bill becomes law?
Currently, the Colorado "Film and Television Incentive Program" offers a 10% rebate on various kinds of qualified local production activities. Some of these types of production activities may include: feature films, commercials, corporate and industrial videos, documentaries, television series and pilots, music videos, video games and other types of new media projects.
If you have a Colorado based production office, you must spend a minimum of $100,000 on local production expenses to qualify for the rebate. If your production office is based outside of Colorado, you must spend a minimum of $250,000 on local production expenses to qualify for the rebate. Some of these local expenses may include: story development, set construction, crew, talent, wardrobe, payroll, lodging expenses, groceries, catering, equipment rentals, travel / airfare, insurance, post-production and much more.
If you would like to apply for the Colorado film incentives program, you must fill out a "Statement of Intent" and send it to "The Office of Film, Television & Media" as soon as you have determined your shooting dates. This financial obligation will allow the state of Colorado to put the appropriate rebate money aside for your project.
